Terms of Service

1. Acceptance of Terms

By creating an account or using SipherMail (the "Service"), operated by SipherMail ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms apply to all users of the Service, including users of the website (siphermail.com), iOS application, Android application, and any related APIs or services.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By using SipherMail, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information when creating your account.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Free and Paid Plans

SipherMail offers a free tier with limited features and paid subscription plans (Personal Pro, Business Starter, Business Pro, Enterprise) with additional features and capacity.

4.2 In-App Purchases (iOS and Android)

Subscriptions and consumable purchases (such as AI credit packs) made through the iOS or Android apps are processed by Apple (App Store) or Google (Google Play Store), respectively. These purchases are subject to the terms and conditions of the respective app store. Refund requests for in-app purchases must be directed to Apple or Google.

4.3 Web Payments

Subscriptions purchased through the SipherMail website are processed by Stripe. Billing occurs on a recurring basis (monthly or annually) depending on your selected plan. You may cancel your subscription at any time; access continues until the end of the current billing period.

4.4 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice.

4.5 Refunds

For web (Stripe) purchases, refund requests are handled on a case-by-case basis within 14 days of purchase. For app store purchases, refunds are governed by Apple's or Google's refund policies.

5. Acceptable Use

You agree not to use the Service to:

  • Send spam, bulk unsolicited messages, or phishing emails.
  • Distribute malware, viruses, or other harmful code.
  • Harass, threaten, or impersonate others.
  • Violate any applicable laws or regulations.
  • Transmit content that is illegal, defamatory, obscene, or infringing on intellectual property rights.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service in any manner that could damage, disable, or impair our infrastructure.
  • Use automated means (bots, scrapers) to access the Service without our written permission.

We reserve the right to suspend or terminate your account and report violations to law enforcement if you engage in prohibited activities.

6. AI Features

SipherMail offers optional AI-powered features (summaries, rewriting, translation, smart replies, Sipher AI). These features require your explicit opt-in consent. When enabled:

  • Selected email content is processed on SipherMail's own servers.
  • AI-generated content is provided "as-is" without guarantees of accuracy, completeness, or appropriateness.
  • You are responsible for reviewing AI-generated content before sending or acting upon it.
  • AI features are subject to usage limits based on your plan tier. Additional AI credits may be purchased.
  • You can disable AI features at any time in Settings.

7. Your Content

You retain ownership of all content you create, send, or store through the Service (emails, drafts, attachments, contacts). By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing and improving the Service.

We do not claim ownership of your content, and we will not use your content for advertising or marketing purposes.

8. Privacy

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

9. Intellectual Property

The Service, including its design, logo, software, and documentation, is owned by SipherMail and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, unless permitted by applicable law.

10. Account Termination

  • By you: you may delete your account at any time from Settings → Account. Upon deletion, your data will be permanently removed within 30 days.
  • By us: we may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or upon request by law enforcement. We will provide notice when reasonably possible.
  • Effect of termination: upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for the content of emails sent or received through the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIPHERMAIL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless SipherMail from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which SipherMail is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.

15. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
